Terms of Use & End User License Agreement

These terms govern your use of Vichar (the "App"). By downloading, installing, or using the App, you agree to these terms. If you do not agree, do not use the App.

1. What Vichar is — and isn't

Vichar is a sleep-sound recorder and morning-report app, built for curiosity and entertainment. Vichar is not a medical device. It does not detect, diagnose, monitor, or treat any medical, sleep, or health condition (including but not limited to sleep apnea, insomnia, or any sleep disorder). Nothing in the App constitutes medical advice. If you have concerns about your sleep, health, or wellbeing, consult a qualified healthcare professional — not this App.

2. Transcripts are automatic and imperfect

Vichar uses on-device speech recognition to transcribe sound it records. Sleep talk is frequently mumbled, indistinct, or overlapping with other noise. Transcripts may be incomplete, inaccurate, or entirely wrong. Treat every transcript as approximate, not as a verbatim or reliable record of what was said.

3. AI-generated readings

If you choose to enable AI interpretation by supplying your own API key, any "reading," "interpretation," or similar output generated by that third-party AI provider is informed guesswork, not analysis of you. AI systems can hallucinate — stating things confidently that are simply untrue, or that your transcript never said. AI-generated content is provided for reflection and entertainment only and should never be treated as fact, advice, or a professional opinion of any kind.

You are solely responsible for the API key you provide and for any charges, usage limits, or terms imposed by the third-party AI provider you choose. We are not a party to your relationship with that provider.

4. Your recordings

You retain all rights to the audio you record and the transcripts generated from it. Vichar does not claim ownership over your recordings. You are responsible for ensuring you have the right to record any person other than yourself who may be audible in a recording (for example, a partner sharing the same room), and for complying with any laws in your jurisdiction regarding audio recording consent.

5. Subscriptions

Vichar may offer optional paid subscriptions for extended functionality. Subscriptions are billed through the Apple App Store or Google Play and are subject to their respective terms, including auto-renewal and cancellation policies. You can manage or cancel your subscription at any time through your Apple ID or Google Play account settings. We do not process payments directly and do not control App Store or Play Store billing, refund, or cancellation mechanics.

6. License

Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use Vichar on devices you own or control, for your personal, non-commercial use, in accordance with the applicable App Store's usage rules.

7. Prohibited use

You agree not to:

• Use Vichar to record any person without a lawful basis or required consent;
• Reverse-engineer, decompile, or attempt to extract the source code of the App, except as permitted by law;
• Use the App in any way that violates applicable law; or
• Use any AI-generated output from the App as the basis for a medical, legal, or safety-critical decision.

8. Alarm reliability

Vichar is built with care to make its alarm function reliable, but we cannot guarantee an alarm will sound under every possible device condition (for example, a device that is powered off, has its volume muted at the operating-system level, is in an unsupported low-power state, or has been force-quit and prevented from running in the background). Do not rely on Vichar as your sole means of waking for any situation where missing an alarm would cause serious harm.

9. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT TRANSCRIPTS WILL BE ACCURATE, THAT AI-GENERATED CONTENT WILL BE RELIABLE, OR THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE APP — INCLUDING DAMAGES RESULTING FROM A MISSED ALARM, AN INACCURATE TRANSCRIPT, OR AI-GENERATED CONTENT.

11. Changes to these terms

We may update these terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised terms.
